Wow it's been awhile

I just realized how long it's been since I posted on this blog. I've been posting on my primary blog and completely forgot about this one until my son asked me about starting a blog. He knows I won't let him have MySpace so I told him that a blog is the easiest way for him to do what he wants and he can post the same as he can on MySpace.

So now I just need to create a subdomain for him and setup the blog on here for him. That should take all of about 10 minutes and that's with a smoke and beer break.

I guess I'll be posting more often on here once I get things straightened out with the other things going on in my life.

Text-message ruling could change corporate policies

I've been waiting for something like this to happen and to be honest, I'm glad that it finally did.

Text-message ruling could change corporate policiesJun 19, 2008 7:51 PM EST

SAN FRANCISCO - Most employees know their bosses are usually within their rights snooping on workers' e-mail, but text messaging has been in murkier territory.

A federal appeals court sought to clarify matters in a ruling Wednesday by distinguishing between electronic communication that employers store on their servers, or pay someone to store, and communication they contract out for.

Employers must have either a warrant or the employee's permission to see messages that aren't stored by the employer or by someone the employer pays for storage, the court said.

The ruling from the 9th U.S. Circuit Court of Appeals in San Francisco, hailed by digital privacy advocates, could create new administrative hurdles for companies to clear before handing out wireless devices.

Employers may now need to use more concrete language in their privacy policies and make sure they explicitly assert access to text-messages as well as e-mail, to encompass communications that aren't under their physical control. To spare lengthy court battles later, written agreements covering employees' work-issued cell phones, for example, probably should say employers have the right to see all e-mail and text messages their workers send with the devices.
Among other privacy advocates, Jeff Chester, founder and executive director for the Center for Digital Democracy, praised the ruling.

"Mobile privacy is increasingly a political and legal battleground - it's a very confusing regulatory landscape, there are no clear rules in the crazy quilt of the mobile communications systems," Chester said.
The ruling limits all kinds of entities' access to consumers' communications, he said.
"Preserving as much privacy for the mobile consumer, and limiting the ability of government and commercial entities to readily access your mobile information is important, and the court did the right thing here," Chester said.

Corporate e-mail has typically been stored on a company's own servers or on server space it pays for, which employers control, according to federal law. Text-messaging has typically been managed by outside providers.

The lower court had ruled that employers have access to text messages because they're stored by the outside contractors, but the 9th Circuit found that the storage was incidental. Greater privacy protections apply, the court said, because employers are paying only for messaging services.

It's not clear, however, how employers should now manage the relationship with an employee who splits the bill for a work-issued cell phone or other message device, a common arrangement.
In that case, the employee might be reluctant to give his employer full access to his text messages, since some are presumably personal.

"It's going to highlight for businesses the need to think through, 'What kind of information do they need? What kind of access do they need to have? And what kind of documentation do they need to have in place to get that access?'" said Joel Reidenberg, a professor at the Fordham University School of Law and an expert on information privacy law. "A ruling like this is going to force companies to be more nuanced and careful in their data management, and that's a good thing."

The ruling came in a lawsuit filed by police officers in the Southern California city of Ontario alleging the police department illegally examined text messages they sent from work-issued pagers.

The department wasn't investigating the officers for a crime. It was trying to determine how much money one of them, Sgt. Jeff Quon, a member of its SWAT team, should pay for personal text messages.

The officers argued - and the appellate court agreed - that the department shouldn't have been able to view the messages without their approval or a court order. They rested the argument on existing legal distinctions between service providers being paid for storage and those that aren't.
In the case of the Ontario police officers, the 9th Circuit agreed they had a reasonable expectation of privacy in their text messages because the department had an informal policy of not examining text messages that employees paid for. The court said the department's search violated the officers' Constitutional protections against unreasonable searches and seizures.

"The holding that text messages and e-mail are protected by the Fourth Amendment is an immensely important one which gives the victims of unlawful searches the ability to suppress illegally obtained evidence," Jennifer Granick, civil liberties director at the Electronic Frontier Foundation, wrote in a posting on the organization's Web site.

Waiting for summer

Well its spring now and I'm still scraping the ice odd my windows every morning and its really starting to bother the hell outa me. I know its Michigan and its standard for winter but this year had been the worse then I can remember.

So now the new project at http://www.dataoutages.com has really taken off and our traffic level is climbing by the day as well as the mail list subscriber base, I'm finding that I'm at a part of my life where I want to get out of the IT field. The problem is, I can't see myself doing anything else. I just want a basic 9-5 job now so I can spend more time with my family and not have as much stress in my life.

So once July comes around, I'll be looking at other fields to see what else is out that I can do with my background. Until then, xanax had become my best friend.

2008 = time for a change

Well last night I was doing some serious thinking about 2007 and reflecting back on 2007 and what I wanted to change for 2008. Karen and I really talked and I mean REALLY talked for the first time in longer then I can remember last night until about 1am.

For the last few months, I've been very grouchy at home and feel like I'm walking on eggshells at work. I put the 2 together and I think everyone can figure out what I'm talking about doing next. I'm going to start putting some feelers out out a new job and see what the market is like. I just feel like there's no room for growth for me and I'm handcuffed as far as what I'm able to do with a network that I built from the ground up and what the CEO really wants.

So this morning I emailed a friend from High School that we saw at our 20 year reunion and he had offered me a job at the time and I'm hoping that offer is still open. I have to do what's best for my family and myself.

No florida for xmas

So its saturday and we are spending xmas at home. I couldn't get clearance to go and the $ is just too tight this year.

So we're going to spend time at church and then catch a movie on christmas instead. With all the bills from my health problems coming in now, I'm trying to find another part time job but being in IT, its hard to find something that I can fit in my schedule.

This will probably be my last post for 2007 but that all depends what happens in the next 2 weeks.

Feeling like a proud papa

In the mobile community, there is one site that everyone talks about. That site is the Boy Genius Report. Today they did a story on my new pet project at Dataoutges.com

I'm not sure what to feel just yet as this site and the mail lists have really taken off into something I didn't think would ever happen. I know that I'll be one happy camper the rest of the day.

All good things must come to an end

That saying has never been so true and it applies to a site that became very popular in the wireless world. For about 4 years I ran a site called Personalwireless.org which was a news blog more or less but we were best known for our Tools archive more then anything. The tools archive will still stay up because that’s the most popular part of the site to be honest. There’s just too much news out there for me to keep up with and still maintain my personal life. The new projects are things that will take up a lot less of my time and allow me to spend more time with our loved one’s but still continue to give back to the community

The new project which actually surprised me as far as how fast it took up is at Dataoutages.com Personalwireless will be kept up until we start seeing the traffic really drop off or sometime in Febuary 2008. Whichever comes first.

In the meantime, I've started to see a big change in how my day has changed since with the new site, the mail list is the primary thing and that runs itself more or less. I've started to use includes on the new site to save me a assload of editing menu's when I add something new to the site and I saw the difference yesterday when I was modifying some things on it. Normally it would've taken me 15 minutes to edit all the separate pages but instead it took all of about 30 seconds and I was done and off to spend time with my kids.

So with that said, now this new project is not only a great thing for me time wise but also a curse since I won't know what to do with all the free time I'll have.

Blackberry comes to the Parade Rescue

So our church as asked this year to put a float in the Christmas Parade. I'm thinking GREAT, it'll give me something to do instead of standing in one spot watching the parade and now my family can actually be in it. We helped decorate the float and Oxford picked a Hawaiian theme for the parade this year so music was going to be a little hard to come by but we still needed to have Music.

One of the people helping with the float said that his daughter had the music already downloaded to her iPod and we could use that. So come Saturday morning at 11:00am, as we were finishing things up and making sure everything worked and looked good for the parade to start at 2:00pm, the iPod was no where to be found. I had previously downloaded the music to my 8310 and had it on the card. So this is where my Blackberry came in to save the day. I plugged my BB in and loaded the songs. If it was any other Blackberry then the 83xx series then the plug wouldn't have worked but since we have the same size earphone jack as the iPod's and computers, everything worked out great.

I froze my ass off as it was only in the 20's and a nice crisp wind but I was happy that we were able to get our Float in the parade and we got to be in it. The kids had a blast riding on the float and my wife walked beside it with some of our friends from the church passing out candy.

By the time the parade was over with, I was so tired of listening to the music that I deleted off my card as soon as we turned off the main street and loaded up my country music and we listened to that the rest of the way back to the end point.

Well that's how my weekend started on Saturday, the rest of it went by fairly good except for missing Sunday service because my BES server went down at the office and my Nagios server was letting me know just before service started so I had to get in to the office to get it fixed for the exec's.

Ruh-oh

They say be careful of what you wish for as you just may get it. That has come true for my son and myself and I'm not sure how to handle it yet. My son is 11 and up until yesterday he's always said that he hated girls, well that changed and it blindsided me.

My wife was talking to my son yesterday after I got home from work and she comes out with a big grin on her face and proceeds to tell me that our son is now interested in girls and that I needed to have "the talk" with him. I'm thinking GREAT and ruh oh at the same time. I know the talk is coming but I had to find out more of what's going on in his mind so I went in to talk to him about it. He was afraid that I would laugh at him so that's why he didn't tell me but after I explained that it's natural and it makes me happy then he started to loosen up.

After about 1/2 hr of him telling me about a popular girl in school, (isn't that how it always starts?) I then proceeded to give him some advice without going into too much and at the same time, thinking that my daughter is next. My wife was standing outside the door and listening to me and then told him after I walked out that he has a lot of his dad in him so just do what comes natural and he'll be fine, now that's a good thing and that's also a BAD thing. I was and am in no way a "player" and it's up to me to make sure my son doesn't become one.

I know that he'll never have any issues with getting dates but now it's up to me to figure out how to steer him in the right direction and that honestly scares the hell outa me, almost as much as thinking about when my daughter starts getting interested in boys.

I know I can't protect them both the way I've always visioned it because that's just not fair to them but now my world just got hit with a nuke and it's like I'm waiting for this bomb to explode into something I can't contain.

So now I guess I need to start paying even more attention to what they are doing and really listen for any hidden messages when they are talking to not only their mom and myself but also to their friends.

Who needs a iPod when you have a Blackberry.

One of the bonus's of my Crackberry is the nice 6GB MicroSD card that I have in it. I have 3GB's of Song's on it and a couple Movies as well as some shows that I download from http://videos4blackberry.info/joomla/ daily. With the upcoming 4.3 OS release for the Blackberry, it's rumored to support up to 32GB MicrSD cards. I don't see me EVER getting a card that damn size unless I win the lotto since I imagine that's going to be over a grand easy but imagine everything you can fit on it.

As I mentioned already, I have 3GB's of songs on mine, 2GB's of movies and the rest is pictures that I like to keep with me to show off of my wife and kids.

I have a few spare 6GB cards from a vendor that I'm going to load up with movies for the kids to watch on the trip down to Florida for Christmas as soon as I can figure out what one's they will want that won't have me trying to watch also while driving.

So that's about it for today, I see that it's getting close to lunch time so that means I'll head down for a smoke and then come back up to the office for another 5hr's.

Florida and 2007 Christmas

Last year we spent Christmas down in Florida at my in-laws house. It wasn't that fun at all since the day we arrived, we found out that my father in-law was diagnosed with Brain cancer. We didn't spend much time with the in-laws because he was going for chemo treatments everyday and when they were home, he was too tired to do anything.

Well he passed on a couple months later and we thought we weren't going back down to Florida this year because Karen's mom was planning on spending it in California with a friend of hers. Well today she spoke to her Mom and she invited us down again. So now I have less then a month to get ready for it. That includes trying to raise the $, do everything short of Begging my boss for the comp time off between xmas and new years since the office is open and I don't have any vacation or personal days off due to using them all this year for back surgery, and hospital stays for my TIA, (mini-strokes) attacks.

The drive isn't that bad as I'll probably do what I did last year and that's work all day, come home and sleep for 5-6 hours and then load everyone in the car and drive straight through for 22hr's. I don't like sharing the driving because I really hate other people driving as it scares the hell outa me.

So now I need to plan this trip and it's not going to be easy. But I know my Blackberry will be there every step as I put my notes in and of course using the Telenav GPS the entire drive down for traffic reports and then InfoSpace Find It to help find gas, food, etc. I can see the Blackberry will be getting a LOT of use in the next month or so.

Nice addition to keep things safe

Thanks to ebay AGAIN, I was able to pick up a nice black rubber skin for my 8310 Blackberry to keep it safe if by chance it falls from my hands again.

This is a nice little cover that slides very easily over my blackberry and has a nice feel to it, I drove home with my crackberry sitting on my dash to see how well it compared to the eGrips that I love so much for my devices and this held up just as well and gives more protection then the eGrips do because this covers the entire device on the outside. My crackberry didn't slide once and I have a lot of turns to make.

I was showing my boss this yesterday and within 30 seconds of seeing it, told me to order him off ebay right away so that's what I did. I'm glad that I was able to make such a huge impact to this company with just introducing the Blackberry and BES server to everyone. I know they already knew about the Blackberry but believe it or not, a lot of people don't know the power that a BES server gives them or the company.

So now that things are running nice and smooth at the office, short of a new BES server in our India office that's giving me a migrane, it's time for me to look for more projects to keep me busy.

Time to rid myself of the past

As I'm sitting in traffic that doesn't seem to ever move, I've been thinking about somethings and one of them is, why is my IM contact lists so damn huge? I have people on there from companies that I no longer work for and some of the people that I do talk to from those companies have hidden agenda's even though they don't admit it. Some have even tried to egg me on to something that I won't go into.

I've always been good at reading people and it doesn't matter if it's in person, over the phone or over IM. So to those that read my blog and you don't see me on your contact list anymore or you see that your blocked due to MSN Messenger, don't take it personal. It just means that we really have nothing to talk about anymore as I move on to the next chapter in my life.

A day in the life of my Blackberry

5am my alarm goes off and wakes me up, I spend the next 45 minutes catching up on emails before I get out of bed. Then I wake up my son for school and then hop in the shower while my 8310 is updating the 50 RSS feeds that I subscribe to.

While I'm waiting for my coffee to brew up for the drive to work, I go over any new work related emails and determine what my day is going to be like while looking at my calendar agenda.

Since the drive to work is a LOT of stop and go, I read my feeds while at lights and see if there's any news that might get my blood flowing.

I have calendar reminders setup throughout the day to remind me to take my meds and without those, I'd forget so its important.

98% of my emails during the day is responded to from my blackberry. Then during lunch I watch the TV shows that I missed the night before after I download them from a site I'll post tomorrow.

On the way home, Telanav is running keeping me up to date on any traffic issues and helping me get around them. I'm also running Blackberry Tracker so my kids can watch me in real time on a website I tossed together for real time GPS tracking.

Come home and charge the BB while I spend time catching up with the kids and then before I hit the sack for the night, I finish my emails and the latest RSS feeds. By 11:30pm its on the shelf next to the bed and ready to go for the next day.

This is the short version but you get the point. If not then I suggest you get a blackberry and you'll understand.

My perfect device

Earlier in the week I had mentioned what I considered to be MY perfect device in the 8310 Blackberry. Well it arrived yesterday and it hasn't disappointment me yet. I have all the apps loaded on it that's important to me and its working great.

I still need to get some eGrips for it or a black skin to help protect it but for now its safe in my pocket.

I will be using it often today while we get winter clothes for the kids and I'm using it now while my wife is in the dentist chair, (better her then me) to look at sales and what stores have what we need for our kids. I used the GPS mapping on it this morning to help us find the dentist office and it was spot on. I really can't ask for more then that.

So that's it for now, I may be posting more today, depending how bored I get while we're off shopping.

Videos 4 Blackberry

For those of you that like to watch shows like NCIS, and House. I have the perfect site for you if you have a Blackberry. The site is http://videos4blackberry.info/joomla/

I found it the other day on one of the forums that I moderate and have downloaded a few shows to my Blackberry, it's helped me get through my days at work. I just plug my headphones into my 8300 and listen away to my shows. Depending what I have going on, I watch them during my lunch break also.

It's something that you really should check out.

The perfect device

To me at least is the Blackberry 8310. It has built in GPS and everything else that comes with the 8300 Curve. Thanks to ebay and selling some stuff off on ebay, I'm soon to be the owner of one and then all will seem better in the world to me.

I still have my health issues that aren't on this blog since I have no way of migrating my old posts here but I plan on keeping the old one up for personal reasons. I'm a gadget nut and they are the only things that keep me from going insane during all these issues with my brain and back.

That's all for tonight since I'm waiting for my meds to kick in to get this pain under control so I can sleep. I'll post more after I get stable again.

Moving things around

So this weekend I was messing around with Googles Hosted Domains with a spare domain that I registered a couple years back to use for a mobile email project that never came to life. So far I'm impressed with it and the different services it has but am not crazy about the lack of what I'm allowed to do.

This week, I'm going to continue to play around with it and might start using that domain for my family stuff now the kids are getting old enough for email and we can use the calender to schedule events for everyone so we ALL know what's coming up instead of finding out at the last minute.

With the new church that we just started attending last week, I see us getting more involved and doing more things as a family so its my job to make sure it all comes together and works.

What are people thinking?

Todays post is titled “What are people thinking?” Because for the life of me, I can’t figure it out. Let me explain. Why the hell do people buy Blackberries and then cancel the data service after walking out of the store when they get home? I just don’t understand why they even purchased the device. Is it to look cool or something? A friend of mine is getting the new AT&T 8310 Curve so he can have all his appointments off his Outlook with him at all times. He said that after 1 month then he’s canceling the data service since he has to have it for 1 month to get the rebate which brings his total new purchase cost to $0.

Now I offered to give him my BRAND NEW 8800 + $100 cash for his 8310 as soon as he gets it since he has no plans on using the data service or any other services on it other then the calender. He doesn’t even want to use the camera on the device. So I keep asking WTF are you getting a Blackberry for then? He said because he can get it for free and if his company wants to pay for the data service then he’ll have it. Now that makes NO sense to me at all. Maybe I’m just crazy or something. Someone PLEASE explain it to me because I’m pounding my head on my desk just thinking about it.
